It must be noted that the District Court of Sri Lanka, in the applicable jurisdiction, is the Upper Guardian of Minor Children in a Marriage.

The Non- Custodian Parent may claim for Reasonable access. The District Courts in Sri Lanka may decide as to the access to be given to the non custodian Parent.

Normally at the Age of 14 for a Boy and at the age of 16 for a Girl the Court will look into the discretion of the Child, but this is not compulsory.

The Court will always look into the Welfare of the Child when deciding on custody of the Minor Children.

The Custody of very young children ordinarily be given to the mother unless the mother is not an unsuitable (to be determined by court) person to have the custody. However reasonable access would be given to the other Party.
