By section 2 of the Prevention of Frauds Ordinance No. 7 of 1840, the following classes of contract shall be of no force or avail in law, unless they are in writing and signed in the presence of a licensed notary public and two or more witnesses and attested:–

  • sale, purchase transfer, etc. or mortgage of immovable property;
  • any promise, bargain, agreement, etc. for effecting any such object or for establishing any security, interest or encumbrance, affecting immovable property;
  • any contract, etc., for the future sale or purchase of immovable property.
